The rules of the road for using Creative Haven.
By creating an account, signing in, or otherwise using Creative Haven (the “Service”), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you may not access or use the Service. These terms form a legally binding agreement between you and Cre8rite Studio (“we”, “us”, or “Creative Haven”).
You must be at least 16 years old (or the age of digital consent in your country) to create an account. If you are under 18, you confirm that your parent or legal guardian has read and accepted these terms on your behalf. You are responsible for providing accurate, truthful information at registration.
You are responsible for keeping your password and session credentials confidential and for all activity under your account. Notify us immediately at security@cre8rite.studio if you suspect unauthorized access. We are not liable for losses from compromised credentials you failed to protect.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Creative Haven for creating, producing and collaborating on audio drama, audiobook and soundscape projects. This license is tied to an active subscription (Free, Creator or Pro) and ends if your account is terminated.
You retain all rights in the scripts, recordings, casting calls, session data and other material you upload or create (“Your Content”). You grant Cre8rite Studio a worldwide, royalty-free license to host, store, process and display Your Content solely to operate the Service for you. You warrant that Your Content does not infringe third-party rights or applicable law.
Cre8rite Studio and Tell-u-Rite LLC utilize specialized artificial intelligence tools (including the AI Dramaturg) solely for real-time creative assistance, script analysis, and formatting support. User Content — including written scripts, series bibles, audio recordings, voice audition files, and master soundscapes — is processed exclusively to deliver features to you. User Content is never used, stored, or processed to train, fine-tune, validate, or improve public, commercial, or third-party generative AI models. AI output is generated probabilistically and may contain inaccuracies. You are solely responsible for reviewing, editing and verifying any AI-assisted material before publishing or distribution. We do not claim ownership of AI-assisted output you create.
Creator ($12/mo) and Pro ($29/mo) plans are billed monthly via our payment processor. Fees are non-refundable except where required by law. You can cancel at any time; access continues until the end of the current billing period. We may change pricing with at least 30 days' notice, applying only to future renewal periods.
You will not use Creative Haven to upload unlawful, infringing, abusive, harassing or deceptive content; to scrape or reverse-engineer the Service; to overload our infrastructure; or to attempt unauthorized access. Casting calls, audition submissions and marketplace listings must be genuine and accurately described. Violations may result in content removal or account termination without refund.
Casting calls, audition recordings and writers-room collaborations involve relationships between you and other users. Creative Haven facilitates these connections but is not a party to any agreement, employment, or compensation arrangement between users. You are solely responsible for complying with labor, tax and union regulations applicable to voice work and auditions in your jurisdiction.
Users retain 100% ownership and copyright of all scripts, production assets, character bibles, sound files, and original audio created or uploaded to Cre8rite Studio. Submitting an audition through the Casting Office grants the project owner a temporary, non-exclusive license to review and evaluate the performance within the platform. Submitting an audition does not transfer ownership, commercial rights, or sync rights to the vocal performance. Full commercial distribution rights require the execution of a formal Voice Release agreement via the Contracts & Rights Hub or an external contract executed by both parties.
Recordings and session files are stored in private buckets with time-limited access links. We retain Your Content for as long as your account is active. Deleted takes are removed from storage and the database. We may enforce reasonable limits on storage volume and bandwidth, and will notify you before restricting access.
The Service may integrate with payment, analytics and AI providers. These providers process data under their own terms. We are not responsible for the practices of third-party services you connect to your account.
You may delete your account at any time. We may suspend or terminate access for violations of these terms, security risks, or prolonged inactivity. On termination, we will make a reasonable effort to let you export Your Content for 30 days, after which it may be permanently deleted.
The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation, or that your work will be recoverable in all circumstances. To the maximum extent permitted by law, any implied warranties are disclaimed.
To the extent permitted by law, Cre8rite Studio and its affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of revenue, data or creative work arising from your use of or inability to use the Service. Total liability is limited to the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Cre8rite Studio from claims, damages and expenses arising from Your Content, your breach of these terms, or your violation of third-party rights or applicable law.
We may update these terms from time to time. Material changes will be announced at least 30 days before they take effect. Continued use after the effective date constitutes acceptance of the revised terms.
These terms are governed by the laws of the jurisdiction where Cre8rite Studio is established, without regard to conflict-of-law principles. You and we agree to attempt good-faith resolution of disputes before pursuing formal proceedings.
